Judge Upholds State Law In Maryland Wrongful Death Case

January 24, 2012

Justice will not come for one Maryland family until a state drunk driving liability law is changed. According to NBC 4 News-Washington, the parents of a 10-year-old girl who was killed by an over served bar patron who drove home after having 18 drinks, cannot file a $3.25 million lawsuit against the bar that over served the drunk driver because state law protects bars from being held liable for drunk driving accidents.

The accident happened in December of 2010, when a driver left the Dogfish Head Ale House in Gaithersburg, Maryland, after consuming large amounts of alcohol. Just after getting onto I-270 though, he collided with a Jeep. The crash killed the young girl riding in that vehicle.

Despite the upsetting decision Friday by the judge ruling to uphold the law, he did write a recommendation that the court of appeals examine the case further. The court of appeals could then overturn the decision, allowing victim’s families to hold an establishment accountable for over serving patrons when injury or wrongful death results.

The Maryland wrongful death attorneys with ChasenBoscolo Injury Lawyers understand the importance of being able to prove liability in a wrongful death case. If you have lost a loved one because of someone else’s mistake, we may be able to help. Contact an experienced attorney today.

January 17, 2012

The man responsible for hitting and killing an 8-year-old boy in Alexandria, Virginia, Sunday afternoon, as well as severely injuring the boy’s mother, was due in court today to face charges of DUI Manslaughter and other crimes. Reports from ABC 7 News say the accident took place as the woman and boy walked westbound along Duke Street.

The Alexandria Police Department reported that the 22-year-old driver had a blood alcohol level of 0.15%, nearly double the legal limit, when he veered his 1994 Honda Accord of the right side of the road, just before the I-395 overpass. It was there that he struck the young boy and his mother. The child was pronounced dead at the scene of the crash, while his mother suffered broken legs and a fractured pelvis. She was taken to INOVA Fairfax Hospital, where she was last listed in stable condition.

The driver remained at the scene of the crash and was arrested after failing field sobriety tests.

A judge ruled this morning that the driver would be held without bond until a trial can begin February 13. He will then face not only the DUI manslaughter charge, but also charges of DUI maiming, reckless driving and driving without a license following an investigation.

Swiss Drug Maker, Novartis, In The Midst Of Dangerous Dilemmas

January 10, 2012

In the past two months, the Swiss drug maker, Novartis, has been plagued with problems ranging from deadly side effects of new drugs to dangerous mix-ups in the manufacturing and packaging of medications.

The reports began in December of 2011 when a 59-year-old multiple sclerosis patient dropped dead after taking his first dose of a trial medication, Gilenya. An article by Reuters said that the patient was monitored for six hours after taking the medication with no incident. The drug company stated that the drug is known to slow the heartbeat, but returns to normal after several hours. The investigation into determining the cause of death in the patient is still ongoing.

Just as the media attention surrounding the patient’s death began to die off, the company was broadsided by another harmful mistake, this time in the manufacturing of old drugs. 9 News Now reported yesterday that the company had recalled certain drugs in response to a mix-up at a Lincoln, Nebraska, manufacturing facility that may have accidentally packaged prescription painkillers into bottles of several over-the-counter medications. Officials believe that opioid painkillers, such as Percocet, Endocet, Opana and Zydone may have accidentally been packaged in bottles of Excedrin, Gas-X, Bufferin and NoDoz.

The Maryland drug injury lawyers with ChasenBoscolo would like to pass on the advice given by the drug’s manufacturer to confirm that all medications recently purchased are correctly packaged by comparing the pills in the bottle to the picture on the outside label.

Two Killed, Three Injured In Alcohol Related Maryland Crash

January 3, 2012

Alcohol is being blamed for an accident in Bethesda, Maryland, that took the lives of two young people and injured three others on New Years Day. According to WUSA 9 News, the car crash happened at around 3:00 AM Sunday along the westbound lanes of Jones Bridge Road.

Neighbors said they thought it was an explosion or a roof collapse that they heard when the driver of the 2007 White Chevy Trailblazer, driven by a 22-year-old man, left the road and went over a sidewalk and down an embankment. The SUV crashed through a fence before hitting a large tree head-on. A 20-year-old male in the front passenger seat was instantly killed in the crash, along with an 18-year-old girl who was in the rear passenger seat.

Two other passengers in the vehicle suffered non-life threatening injuries and were taken to nearby Suburban Hospital for treatment. The driver of the vehicle was critically injured in the crash and was airlifted to Shock Trauma in Baltimore to receive treatment. Charges are pending against the driver once he is released.

According to the National Highway Traffic Safety Administration (NHTSA), motor vehicle accidents are the single leading cause of death for American teenagers. Of those accidents, they say that 60 percent were alcohol related.

The Maryland auto accident attorneys with ChasenBoscolo Injury Lawyers would like to urge parents to talk to their teens about the dangers of not only driving drunk, but also riding in a car with someone who has been drinking.

One Treated For Smoke Inhalation After Fire Erupts In Baltimore Building

December 27, 2011

A two-alarm fire in a Baltimore, Maryland, home business sent one woman to the hospital early this morning. According to WBALTV 11 News, the fire broke out around 2:45 AM in one of the buildings along East 25 Street, in the Charles village area.

Firefighters said they arrived at the scene to find smoke rising from the lower floors of the building. After their arrival, the fire spread through the duct work throughout the building to the upper floors.

Baltimore City Fire Department spokesperson Chief Kevin Cartwright stated that two occupants were in the building at the time of the fire. One man was able to escape the blaze uninjured, while a woman suffered smoke related injuries. She was taken to shock trauma to be treated for smoke inhalation. Investigators do not suspect foul play was a cause of the fire.

A new study on smoke inhalation has showed that it can result in delayed pulmonary complications. The more concerning discovery, though, was that the most common cause of death in burn units across the country is now respiratory failure.

The Maryland fire and burn injury lawyers with ChasenBoscolo are compassionate to each fire and burn injury client’s needs and fight to get them the care they require in order to live a productive life after the fire. Maryland Boating Accident Leaves One Dead, One Injured, And Another Missing

December 20, 2011

The search is still on for a 25-year-old man who went missing in the Chesapeake Bay after his sailboat capsized near Sandy Point State Park. According to NBC-Washington, two other individuals were on the boat when it went down. One was a 40-year-old man who died shortly after being pulled form the frigid waters by Coast Guard Rescue Crews. The other was a 25-year-old woman who survived, but required treatment for hypothermia.

It was around 2:30 p.m. last Saturday when rescuers received a Mayday call from the boat saying that it was taking on water. When rescuers found the quickly sinking sailboat, only the middle-aged man and woman were found. The woman was treated for hypothermia by paramedics and released, while the man was taken to Anne Arundel Medical Center where he later died. The victims told crews there was another 25-year-old man with them when the boat went down. This information prompted a search of the area involving five different departments over a 62-square-mile area.

The search was called off Sunday due to bad weather, but promptly picked up Monday when the weather cleared.

All three victims were wearing life jackets at the time of the accident.

The Maryland Maritime Injury Attorneys with ChasenBoscolo say that wearing a life preserver is the best way to protect yourself from harm when on a boat. In fact, the Coast Guard says capsizing and falls overboard are the most reported types of fatal accidents, accounting for 59 percent of all boating fatalities.

Montgomery County Worker Falls Into a 16-Foot Ditch

December 13, 2011

A construction crew foreman was injured Tuesday morning after being knocked into a trench at a work site in Montgomery County, Maryland. According to NBC-Washington, the accident occurred at Washington Grove Road and Mid-County Highway.

Reports indicate that just before 9:00 AM, a Ride-On bus was passing the construction zone when it struck a construction barrel. The barrel in turn hit the foreman who toppled into the 16-foot roadside ditch.

Rescuers pulled the worker out from the ditch safely using a basket and crane. The man was then transported to a nearby hospital to be treated for serious, but non-life threatening injuries.

The Occupational Safety and Health Administration (OSHA) was called to the scene to investigate the accident alongside Montgomery County Sheriffs, who are working to determine if any charges will be placed against the bus driver.

The Bureau of Labor Statistics (BLS) says that although the number of fatal accidents in the construction industry declined in 2010, the industry still ranked as the most deadly in the nation. In 2010, 530 construction workers died on-the-job, down from 621 the year before.

The Maryland Workers’ Compensation Attorneys with ChasenBoscolo say that workers injured on-the-job need to file an insurance claim in order to receive benefits compensation. Often times though, the insurance company does not offer you a settlement for the amount of money you need. That is when you should contact an experienced attorney to fight for you!

Disaster was narrowly averted Monday night in Prince George’s County after a tanker truck, box truck and car were involved in a collision. According to ABC 2 News, the crash happened at around 9:40 PM along the southbound lanes of Route 3 near Bowie, Maryland.

The accident happened when a tanker truck carrying nearly 9,000 gallons of fuel was struck by two other vehicles and overturned. The impact of the collision caused the tank to rupture and nearly 100 gallons of fuel had spilled onto the highway. The incident occurred Monday at around 1:30 in the afternoon at Davidsonville Park. The victim told police that a man believed to be in his 20’s was handling three leashed dogs as he passed the jogger. The animals lunged and quickly overtook the the victim. Three Maryland Residents Poisoned By Carbon Monoxide

November 22, 2011

As the weather cools and we begin to turn the heat on in our homes during chilly nights, we are reminded of the dangers carbon monoxide poses. The Center for Disease Control and Prevention (CDC) says every year, more than 500 deaths and 15,000 trips to the emergency room are on account of unintentional carbon monoxide exposure in the home.

Take the case of the Aspen Hill, Maryland, residents who were listed in critical condition after a gas leak at their apartment complex.  According to ABC 7 News, a faulty furnace in the building was discovered to be at fault for three residents who became ill after gas flooded their units. Rescue units from the Montgomery County Fire Department were dispatched to the scene, where they proceeded to evacuate all other residents and help those harmed by the poisonous gas. Firefighters said carbon monoxide levels had reached 700 parts per million (PPM) in the units–significantly higher than the 35 PPM needed to begin to feel the effects of the gas poisoning the body.

The best way to protect your home from dangerous gas leaks is to install carbon monoxide detectors in each room. The units should be placed within 10-15 feet of all bedroom doors in your home. Also, have furnaces inspected by your gas provider or technician before running the unit each year.
